What Is Deportation And What Are The Steps The Government Takes?
Deportation is the process the US government takes to remove an undocumented non-citizen from the country for violating immigration law. It may or may not include the arrest of the non-citizen, and the non-citizen may be held in a detention center. Here are the standard steps of deportation:
- The foreign national receives an NTA (he/she may or may not be placed in a detention center).
- The individual is required to go to an immigration court hearing where the judge will determine:
- Whether the individual has been appropriately served the Notice to Appear (NTA).
- If the person is removable. If the person has admitted or conceded that they are removable. If the ICE official(s) has provided enough proof to confirm that the person is removable.
- A person who is to be removed (deported) may apply for relief from removal or deportation. Contact Attorney Segreto to explore your options and determine if you or your loved one qualifies.
“The New Colossus“
Not like the brazen giant of Greek fame,
With conquering limbs astride from land to land;
Here at our sea-washed, sunset gates shall stand
A mighty woman with a torch, whose flame
Is the imprisoned lightning, and her name
Mother of Exiles. From her beacon-hand
Glows world-wide welcome; her mild eyes command
The air-bridged harbor that twin cities frame.
“Keep, ancient lands, your storied pomp!” cries she
With silent lips. “Give me your tired, your poor,
Your huddled masses yearning to breathe free,
The wretched refuse of your teeming shore.
Send these, the homeless, tempest-tost to me,
I lift my lamp beside the golden door!”
~ Emma Lazarus
